Person whose name is not in the FIR or chargesheet can be tried: SC


The Supreme Court has stated that a person whose name is not mentioned in the FIR or a chargesheet but his involvement in an alleged crime emerges during the trial is in process can also be tried. Evidences against the said person will be enough when the evidences are being registered and not during the witnesses’ cross-examination. The court was responding to five questions referred to it in Dec 8, 2011, by a three member judge bench when the Section 319 of the Code of Criminal Procedure would be implemented. This section entails to provisions under which a person whose name comes to the fore during the trial but who has not been chargesheeted and his name does not appear in the FIR as well. The questions which were asked were when exactly Section 319 can be brought into vogue. The questions also entailed to the nature of ‘evidence’. Did that mean only what came in the cross examination of the witnesses but court can exercise Section 319 even based on the statement made in the examination-in-chief of the witness related to the case. What would be the prerequisites for the court to exercise the power, will that be only when there are possibilities that the accused will be convicted. Also there was a query regarding whether this would entail to a person whose name was not there in the FIR or it was there but there were no charges or it concerns a person who has been discharged.

Devyani Khobragade leaves the US, India expels US diplomat

Devyani Khobragade, the senior Indian diplomat was asked to leave the US. She is on her way back to India. This is after a month when she was arrested when she had gone to drop her daughter to school, she was handcuffed and strip searched for alleged visa fraud and had to share a cell which also had drug dealers kept in the same cell. She was been provided G1 visa with full diplomatic immunity on Jan 8". The way she was treated for underpayment of her daughter’s nanny Sangeeta Richards had led to outrage back home. She held the position of deputy consul general of India in New York. She was indicted by a grand jury in the US on January 9, 2014. Preet Bharara , the attorney in Manhattan said the charges against Khobragade would be there and she will have to appear before the court when her immunity status will have to be waived or she will come without immunity status. 

On the other hand, India had an officer from the US removed from its New Delhi embassy and as per sources has put charges on this officer of having a role in the circumstances which led to Devyani's arrest.

Akhilesh defends Saifai Mahotsav, lashes at media

The Uttar Pradesh CM Akhilesh Yadav has lashed at the media for prejudiced reporting regarding the recently concluded Saifai Mahotsav in the native village of Mulayam Singh Yadav. He stated that this event was being hosted since 1997 and was for the people in lower bracket of income and had been hosted without taking into consideration whether the SP was in power or not. He also dismissed the fact that Rs 300 crores were spent on the event and stated that not more than Rs 10 crores were spent. He lashed at the journalists who according to him attended the event, hankered for passes and even sat on floor to witness the film star studded event and then went ahead and talked bad about it. He specified that what his government has done in Muzaffarnagar relief operation has been overlooked and it is being criticized mainly. Saifai event drew a lot of flak on the fact that government was busy in merry making while people in relief camps at Muzaffarnagar were living in deplorable conditions.

Export growth dips to all time low in 6 months


Export growth touched to a 6 months low of 3.49% in December as there was a decline in the shipment of petroleum goods. This one good has impacted the growth of exports . the commerce secretary SR Rao informed that there was a shutdown for maintenance in one of the biggest exporters of the country, Reliance Industries and moreover it was not planned. The exports were to the tune of $26.3 billion in December whereas it was $25.4 billion in December 2012. Petroleum exports showed a slump of 16% last month. What helped at the same time was the fact that there was a dip of a 15.25% in imports to $36.4 billion, mainly in gold and silver shipments, which brought the trade deficit to $10.1 billion in December. In the month before it was $9.21 billion.

Franchises retain their strong players for 7th edition of IPL


Chennai Super Kings have gone ahead with their five players for the IPL’s 7th edition on Friday. These include skipper MS Dhoni, Ravichandran Ashwin, Ravindra Jadeja, Dwayne Bravo and Suresh Raina. CSK have been most successful in this edition of the game. The big wigs who were not able to make to the team are Michael Hussey, Murali Vijay and Albie Morkel. Now the entry through the new ‘joker’s card’ is the only option left for them. Through this rule each franchise can buy back some of the players who were not retained. On the other hand the RCB franchise maintained their three players who are its pillars like Chris Gayle,Virat Kohli and AB de Villiers. Rajasthan Royals will most probably retain Shane Watson, Sanju Samson, James Faulkner, Stuart Binny and Ajinkya Rahane. The auction will be happening from Feburary 12 and today was the final day for the franchisees to declare the players they were retaining.

Anyone can send mail via Google+ to other users


Google has added a new feature when any Google+ user can send email via the platform. Viewed as a direct encroachment on privacy this would enable any user to send mails to people unknown to them barring the fact that the recipient has opted not to receive the mails in this way. The mails can be sent by typing the users name in the ‘send to’ box. The user’s email address won’t be visible until and unless the reply is not sent via Google+. Before this feature rolled out Google+ integration has been made mandatory for users who want to comment on video links on YouTube which users saw as a measure to force them to create Google+ ids.
