There are a few minor charges that are also imposed by local<\/span><span data-preserver-spaces=\"true\">\u00a0governments, such as the Municipality.<\/span><span data-preserver-spaces=\"true\">\u00a0The government taxes the income of individuals and companies in various ways.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">India&#8217;s Tax Structure<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">In India,\u00a0<\/span><span data-preserver-spaces=\"true\">two main categories of taxes can be distinguished<\/span><span data-preserver-spaces=\"true\">:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Direct Taxes<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">indirect Taxes<\/span><\/li>\n<\/ul>\n<h3><strong><span data-preserver-spaces=\"true\">Types of Direct Taxation<\/span><\/strong><\/h3>\n<h4><strong><span data-preserver-spaces=\"true\">Income Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">The income tax system in India is progressive.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Different income tax rates are applied based on the net income amount.\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">When the total income exceeds Rs 50 lakh but not Rs 1 crore, an additional 10% tax is due.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Tax on Companies<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">It is a tax assessed against corporations&#8217; and businesses&#8217; profits and\u00a0<\/span><span data-preserver-spaces=\"true\">alternatively<\/span><span data-preserver-spaces=\"true\">\u00a0referred to as corporation tax.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">A firm is considered a separate entity for tax purposes and must pay taxes apart from its owners&#8217; income tax.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Corporation tax must be paid by all firms, public and private,\u00a0<\/span><span data-preserver-spaces=\"true\">that are<\/span><span data-preserver-spaces=\"true\">\u00a0registered under the\u00a0<\/span><span data-preserver-spaces=\"true\">firms<\/span><span data-preserver-spaces=\"true\">\u00a0Act 1956 and\u00a0<\/span><span data-preserver-spaces=\"true\">are<\/span><span data-preserver-spaces=\"true\">\u00a0located in India.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">As of January 2022, corporation tax will be payable at 22% by all domestic businesses.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Minimum Alternate Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">To avoid paying corporation tax to the government, companies with high profits and significant dividends to shareholders had to pay minimum alternate tax, calculated as a fixed percentage of book profit.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">As of January 2022, the MAT rate is 15%.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Capital Gains Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">\u00a0<\/span><span data-preserver-spaces=\"true\">A capital gain is any profit or gain that<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><span data-preserver-spaces=\"true\">is made<\/span><span data-preserver-spaces=\"true\">\u00a0when a capital asset\u00a0<\/span><span data-preserver-spaces=\"true\">is sold<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Property, buildings,\u00a0<\/span><span data-preserver-spaces=\"true\">jewelry<\/span><span data-preserver-spaces=\"true\">, patents, and copyrights are capital assets.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">However, jewels and debt-oriented mutual funds are not subject to this change since they are transportable.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Capital gains taxes on short- and long-term profits are imposed differently based on the quantity of income received.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Transaction Tax on Securities<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">A tax is the securities transaction tax on gains on securities, such as shares, options, and futures, that\u00a0<\/span><span data-preserver-spaces=\"true\">are exchanged<\/span><span data-preserver-spaces=\"true\">\u00a0on the domestic stock exchange.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Transaction Tax on Commodities<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">Both buyers and sellers of exchange-traded non-agricultural commodity derivatives in India are liable for the commodity transaction tax.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Metals and energy goods are examples of non-farm commodities that fall under the purview of CTT.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Alternate Minimum Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">For limited liability partnerships, the Alternate Minimum Tax (AMT) is equivalent to the Minimum Alternate Tax (MAT) for corporations.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">This tax does not apply to other commercial entities, such as partnerships, associations of people, and sole proprietorships.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Estate Duty<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">1953 saw its original presentation. A person&#8217;s belongings are subject to their estate upon death.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The deceased&#8217;s entire estate is considered his riches and is subject to taxation.\u00a0<\/span><span data-preserver-spaces=\"true\">However,\u00a0<\/span><span data-preserver-spaces=\"true\">no<\/span><span data-preserver-spaces=\"true\">\u00a0tax\u00a0<\/span><span data-preserver-spaces=\"true\">has\u00a0<\/span><span data-preserver-spaces=\"true\">been<\/span><span data-preserver-spaces=\"true\">\u00a0imposed<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><span data-preserver-spaces=\"true\">since<\/span><span data-preserver-spaces=\"true\">\u00a01985.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Wealth Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">It applied to individuals, married Hindu families, and businesses with more net worth than needed.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The tax\u00a0<\/span><span data-preserver-spaces=\"true\">was removed<\/span><span data-preserver-spaces=\"true\">\u00a0starting in 2015.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Gift Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">A public or private organization supporting charitable institutions was the only one whose donations were exempt from the gift tax.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">It wasn&#8217;t until 1998 that\u00a0<\/span><span data-preserver-spaces=\"true\">the tax was collected<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Fringe Benefits Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">In reaction, the government implemented the Fringe Benefits\u00a0<\/span><span data-preserver-spaces=\"true\">levy<\/span><span data-preserver-spaces=\"true\">\u00a0(FBT), essentially a levy that an employer must pay instead of the benefits provided to\u00a0<\/span><span data-preserver-spaces=\"true\">his or her<\/span><span data-preserver-spaces=\"true\">\u00a0employees.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Taxing any benefits utilized to evade paying taxes was the goal.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The fringe benefits tax was removed<\/span><span data-preserver-spaces=\"true\">\u00a0from the 2009 Union budget for India.<\/span><\/li>\n<\/ul>\n<h3><strong><span data-preserver-spaces=\"true\">Types of Indirect Taxation<\/span><\/strong><\/h3>\n<h4><strong><span data-preserver-spaces=\"true\">Customs Duty<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">When commodities\u00a0<\/span><span data-preserver-spaces=\"true\">are carried<\/span><span data-preserver-spaces=\"true\">\u00a0across international boundaries, customs charges\u00a0<\/span><span data-preserver-spaces=\"true\">are levied<\/span><span data-preserver-spaces=\"true\">\u00a0as a tariff or fee.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Customs laws impose various duties, including export duties,\u00a0<\/span><span data-preserver-spaces=\"true\">basic<\/span><span data-preserver-spaces=\"true\">\u00a0duties, countervailing taxes, protective duties, and anti-dumping duties.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The manufacture, distribution, and use of products and services<\/span><span data-preserver-spaces=\"true\">\u00a0are all subject to the\u00a0<\/span><span data-preserver-spaces=\"true\">products<\/span><span data-preserver-spaces=\"true\">\u00a0and Services Tax (GST), a national indirect tax<\/span><span data-preserver-spaces=\"true\">.It<\/span><span data-preserver-spaces=\"true\">\u00a0has superseded all indirect taxes levied on goods and services.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Sales Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">In India, a sales tax is a\u00a0<\/span><span data-preserver-spaces=\"true\">type of<\/span><span data-preserver-spaces=\"true\">\u00a0tax that the government imposes on\u00a0<\/span><span data-preserver-spaces=\"true\">the<\/span><span data-preserver-spaces=\"true\">\u00a0buying or selling a certain commodity within the country. IGST has\u00a0<\/span><span data-preserver-spaces=\"true\">taken its place<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Excise Duty<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">Since excise duty is imposed on manufacturing goods rather than their sale in India, it is a real commodities tax. CGST has assumed this role.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Service Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">In India, there is a service tax on all services provided.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">In India, the service tax rate was 15% until the GST took its place.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Value Added Tax<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">India&#8217;s states and union territories\u2014aside from Andaman Nicobar and Lakshadweep\u2014have implemented Value Added Tax (VAT).<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The tax, which\u00a0<\/span><span data-preserver-spaces=\"true\">is imposed<\/span><span data-preserver-spaces=\"true\">\u00a0on various commodities sold in the state, is set by the state.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">State VAT had taken the role of the State Sales Tax and was in force until July 1, 2017. Since then, SGST has assumed its place.<\/span><\/li>\n<\/ul>\n<h4><strong><span data-preserver-spaces=\"true\">Tax on Dividend Distribution<\/span><\/strong><\/h4>\n<ul>\n<li><span data-preserver-spaces=\"true\">Since dividends are considered income by shareholders, they should ideally be subject to taxation.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The\u00a0<\/span><span data-preserver-spaces=\"true\">tax that the<\/span><span data-preserver-spaces=\"true\">\u00a0Indian government levies\u00a0<\/span><span data-preserver-spaces=\"true\">on Indian businesses is<\/span><span data-preserver-spaces=\"true\">\u00a0based on the\u00a0<\/span><span data-preserver-spaces=\"true\">amount of<\/span><span data-preserver-spaces=\"true\">\u00a0dividends paid to shareholders.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The Finance Minister eliminated the Dividend Distribution Tax in Budget 2020.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The tax system in India is administered by the Central\u00a0Government and the\u00a0State Governments, which\u00a0separately\u00a0impose various taxes.
