{"id":150747,"date":"2024-06-17T09:45:32","date_gmt":"2024-06-17T04:15:32","guid":{"rendered":"https:\/\/www.mapsofindia.com\/my-india\/?p=150747"},"modified":"2024-06-14T21:22:36","modified_gmt":"2024-06-14T15:52:36","slug":"what-is-the-eggshell-skull-rule","status":"publish","type":"post","link":"https:\/\/www.mapsofindia.com\/my-india\/india\/what-is-the-eggshell-skull-rule","title":{"rendered":"What Is The \u2018Eggshell Skull\u2019 rule?"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">The district consumer <\/span><span data-preserver-spaces=\"true\">forum&#8217;s<\/span><span data-preserver-spaces=\"true\"> compensation of Rs 5 lakhs in a medical negligence case was reinstated by the Supreme Court on April 23, underscoring the improper application of the legal principle known as the<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">Eggshell Skull<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">by the state and federal consumer courts.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">What is the<\/span><span data-preserver-spaces=\"true\"> \u2018<\/span><span data-preserver-spaces=\"true\">Eggshell Skull<\/span><span data-preserver-spaces=\"true\">\u2019 <\/span><span data-preserver-spaces=\"true\">rule?<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">The common law notion known as the<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">Eggshell Skull Rule<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">is utilised in civil action.<\/span> <span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> means that the offender would be responsible for any harm that could worsen due to the injured <\/span><span data-preserver-spaces=\"true\">party&#8217;s<\/span><span data-preserver-spaces=\"true\"> unique circumstances, which the offender would not have been aware of. Simply put, even if the victim had an exceptionally delicate skull or an<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">Eggshell<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">for a skull, the defendant would still be liable for whatever harm the victim sustained when he struck him on the head.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The rule applies when a claimant seeks additional compensation for damages above what the defendant might reasonably have been expected to inflict.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The most common source for the eggshell skull <\/span><span data-preserver-spaces=\"true\">rule&#8217;s<\/span><span data-preserver-spaces=\"true\"> beginnings is the Wisconsin case Vosburg v. Putney, which <\/span><span data-preserver-spaces=\"true\">was decided<\/span><span data-preserver-spaces=\"true\"> in 1891. A 12-year-old child named Putney kicked a 14-year-old boy named Vosburg in the shin at a Waukesha, Wisconsin, school. Putney had no idea that Vosburg had previously sustained an injury to the same area of his body. The Wisconsin Supreme Court ruled that the kick<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">caused his (<\/span><span data-preserver-spaces=\"true\">Vosburg&#8217;s<\/span><span data-preserver-spaces=\"true\">) leg to become lame,<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">aggravating the damage.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Justice William P. Lyon ruled that although Putney had no intention of hurting this much, the kick <\/span><span data-preserver-spaces=\"true\">was considered<\/span><span data-preserver-spaces=\"true\"> an<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">unlawful act<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">because it happened after the teacher had called the class to order.\u00a0<\/span><span data-preserver-spaces=\"true\">Ten years after the Putney ruling, the English court <\/span><span data-preserver-spaces=\"true\">system&#8217;s<\/span> <span data-preserver-spaces=\"true\">King&#8217;s<\/span><span data-preserver-spaces=\"true\"> Bench granted damages to a pregnant client who became seriously unwell and suffered a terrible shock when the <\/span><span data-preserver-spaces=\"true\">defendant&#8217;s<\/span><span data-preserver-spaces=\"true\"> servant<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">negligently drove a pair-horse van into the public house,<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">where the client was working behind the bar. She said that as a result, she gave birth to a child who<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">was born an idiot<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">prematurely.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The court stated,<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">It is no answer to the <\/span><span data-preserver-spaces=\"true\">sufferer&#8217;s<\/span><span data-preserver-spaces=\"true\"> claim for damages that he would have suffered less injury, or no injury at all if he had not had a fragile skull or a fragile heart.<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">The guy could have been ran over or otherwise negligently wounded in his body.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">What was the case?<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">A Jyoti Devi underwent an appendix removal in a hospital in the Mandi area of Himachal Pradesh in 2005. Her stomach pain persisted even after the procedure went according to plan. What happened next was a four-year journey that involved multiple hospital stays. In the end, physicians at <\/span><span data-preserver-spaces=\"true\">Chandigarh&#8217;s<\/span><span data-preserver-spaces=\"true\"> PostGraduate Institute of Medical Science discovered that<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">a 2.5 cm foreign body (needle)<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">had become lodged in her abdomen and required to be surgically removed.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">When Jyoti filed a complaint with the district consumer forum, the hospital in Mandi paid her Rs 5 lakhs for medical malpractice. The hospital challenged the ruling, though, and the National Consumer Disputes Redressal Commission (NCDRC) increased the payout to Rs 2 lakh after the state consumer forum cut it to Rs 1 lakh. <\/span><span data-preserver-spaces=\"true\">When the case reached the Supreme Court, it upheld the district <\/span><span data-preserver-spaces=\"true\">forum&#8217;s<\/span><span data-preserver-spaces=\"true\"> compensation decision and declared that the other two courts had used the eggshell skull rule while still awarding a<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">paltry<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">and<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">unjust<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">amount.<\/span><\/p>\n<h3><strong><span data-preserver-spaces=\"true\">What did the SC rule?<\/span><\/strong><\/h3>\n<p><span data-preserver-spaces=\"true\">The Supreme Court ruled that <\/span><span data-preserver-spaces=\"true\">Jyoti&#8217;s<\/span><span data-preserver-spaces=\"true\"> case would not fall under the eggshell skull rule since there is no evidence in her file of a<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">pre-existing vulnerability or medical condition, because of which the victim may have suffered<\/span><span data-preserver-spaces=\"true\"> &#8216;<\/span><span data-preserver-spaces=\"true\">unusual damag<\/span><span data-preserver-spaces=\"true\">e&#8217;.<\/span><span data-preserver-spaces=\"true\">&#8221; <\/span><span data-preserver-spaces=\"true\">The NCDRC had only stated the norm, the court observed, and had not explained<\/span><span data-preserver-spaces=\"true\"> &#8220;<\/span><span data-preserver-spaces=\"true\">how this rule applies to the present case&#8221;. <\/span><span data-preserver-spaces=\"true\">According to the verdict, Jyoti had been suffering for more than five years, and the lawsuit took more than ten years to resolve, both of which made increasing the compensation necessary.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The district consumer forum&#8217;s compensation of Rs 5 lakhs in a medical negligence case was reinstated by the Supreme Court on April 23, underscoring the improper application of the legal principle known as the &#8220;Eggshell Skull&#8221; by the state and federal consumer courts.
