{"id":150948,"date":"2024-06-19T09:45:31","date_gmt":"2024-06-19T04:15:31","guid":{"rendered":"https:\/\/www.mapsofindia.com\/my-india\/?p=150948"},"modified":"2024-06-18T16:36:09","modified_gmt":"2024-06-18T11:06:09","slug":"what-is-saptapadi-ceremony-in-hindu-marriage","status":"publish","type":"post","link":"https:\/\/www.mapsofindia.com\/my-india\/history\/what-is-saptapadi-ceremony-in-hindu-marriage","title":{"rendered":"What Is Saptapadi Ceremony In Hindu marriage?"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">The recent Supreme Court ruling in Dolly Rani v Manish Kumar Chanchal that a Hindu marriage cannot be legitimate without a Saptapadi ceremony is misunderstood.<\/span><\/p>\n<h2><strong>New Supreme Court Ruling: No Saptapadi, No Hindu Marriage<\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">A Hindu lady petitioned to move divorce proceedings from Muzaffarpur, Bihar, to Ranchi, Jharkhand. The couple sought a ruling that their marriage was invalid since <\/span><span data-preserver-spaces=\"true\">no rituals were conducted<\/span><span data-preserver-spaces=\"true\">.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">They said they married in Uttar Pradesh using a<\/span><span data-preserver-spaces=\"true\"> \u201c<\/span><span data-preserver-spaces=\"true\">marriage certificate<\/span><span data-preserver-spaces=\"true\">\u201d <\/span><span data-preserver-spaces=\"true\">from Vaidik Jankalyan Samiti, a local religious group. Using this document, they obtained a<\/span><span data-preserver-spaces=\"true\"> \u201c<\/span><span data-preserver-spaces=\"true\">Certificate of Registration of Marriage<\/span><span data-preserver-spaces=\"true\">\u201d <\/span><span data-preserver-spaces=\"true\">under the Uttar Pradesh Marriage Registration Rules, 2017, and registered their marriage under Section 8 of the HMA.\u00a0<\/span><span data-preserver-spaces=\"true\">The couple petitioned the Supreme Court to nullify the marriage under Article 142. When no law or regulation provides a remedy, Article 142 allows the Supreme Court to perform<\/span><span data-preserver-spaces=\"true\"> \u201c<\/span><span data-preserver-spaces=\"true\">complete justice<\/span><span data-preserver-spaces=\"true\">\u201d <\/span><span data-preserver-spaces=\"true\">between the parties.<\/span><\/p>\n<h2><strong>Supreme Court Decision<\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">Section 7 of the HMA requires documentation of the Saptapadi and other procedures for a Hindu marriage to be legitimate. When Saptapadi is followed, the marriage is final and legally binding after the seventh stage. Even with marriage documents, Hindu law requires these procedures to recognise a marriage. A marriage certificate that states the couple married, but the ceremony <\/span><span data-preserver-spaces=\"true\">wasn&#8217;t<\/span><span data-preserver-spaces=\"true\"> conducted<\/span><span data-preserver-spaces=\"true\"> under Section 7 of the Act <\/span><span data-preserver-spaces=\"true\">won&#8217;t<\/span><span data-preserver-spaces=\"true\"> be valid under Section 8.\u00a0<\/span><\/p>\n<h2><strong>Challenge the Decision<\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">The Saptapdi ritual is one of many ways to solemnise marriage. <\/span><span data-preserver-spaces=\"true\">An essential reading of the Section shows that Hindu marriage rites must follow applicable usage or customs, which the Court <\/span><span data-preserver-spaces=\"true\">simply<\/span><span data-preserver-spaces=\"true\"> stated. <\/span><span data-preserver-spaces=\"true\">Other<\/span><span data-preserver-spaces=\"true\"> rites to legitimise the marriage <\/span><span data-preserver-spaces=\"true\">were not included in the judgement<\/span><span data-preserver-spaces=\"true\">. It ignored customs that <\/span><span data-preserver-spaces=\"true\">include<\/span><span data-preserver-spaces=\"true\"> only garlands and no elaborate rituals.<\/span><\/p>\n<h2><strong>Solemnised Marriage<\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">Solemnising a marriage involves a formal ceremony with rituals. In India, marriage <\/span><span data-preserver-spaces=\"true\">is regulated<\/span><span data-preserver-spaces=\"true\"> by personal laws and the 1954 Special Marriage Act (SMA).<\/span><\/p>\n<h2><strong>Landmark Judgement<\/strong><\/h2>\n<ul>\n<li><span data-preserver-spaces=\"true\">S. Nagalingam v. Sivagami (2001): Tamil <\/span><span data-preserver-spaces=\"true\">Nadu\u2019s<\/span><span data-preserver-spaces=\"true\"> 1967 HMA amendment simplified marriage customs.\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The Hindu Marriage (Tamil Nadu Amendment) Act of 1967 added Section 7-A to the Hindu Marriage Act of 1955. However, it only extended to Tamil Nadu.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Section 7-A: Self-Respect Marriages:<\/span><\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">The specific clause covers<\/span><span data-preserver-spaces=\"true\"> \u201c<\/span><span data-preserver-spaces=\"true\">self-respect and secular marriage<\/span><span data-preserver-spaces=\"true\">s\u201d.<\/span><span data-preserver-spaces=\"true\"> The law accepts<\/span><span data-preserver-spaces=\"true\"> \u201c<\/span><span data-preserver-spaces=\"true\">any marriage between any two Hindu<\/span><span data-preserver-spaces=\"true\">s\u201d,<\/span><span data-preserver-spaces=\"true\"> also known as<\/span><span data-preserver-spaces=\"true\"> \u201cS<\/span><span data-preserver-spaces=\"true\">uyamariyathai<\/span><span data-preserver-spaces=\"true\">\u201d <\/span><span data-preserver-spaces=\"true\">or<\/span><span data-preserver-spaces=\"true\"> \u201cS<\/span><span data-preserver-spaces=\"true\">eerthiruththa<\/span><span data-preserver-spaces=\"true\"> marriag<\/span><span data-preserver-spaces=\"true\">e\u201d.<\/span><\/p>\n<h2><strong>Laws Relating to Marriage in India<\/strong><\/h2>\n<h3><strong>Indian marriage laws vary by religion\u00a0<\/strong><\/h3>\n<ul>\n<li><span data-preserver-spaces=\"true\">Religion determines personal laws in India.\u00a0\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Hindus, Christians, and Parsis are married under the Hindu Marriage Act (HMA) 1955, the<\/span> <span data-preserver-spaces=\"true\">Indian Christian Marriage Act, and the Parsi Marriage Act, respectively.\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Muslims observe the Muslim Personal Law (Shariat) Application Act of 1937.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Lingayats, Brahmos, Aryasamajists, Buddhists, Jains, and Sikhs are covered by the HMA.<\/span><\/li>\n<\/ul>\n<h3><strong>The Hindu Marriage Act, 1955<\/strong><\/h3>\n<ul>\n<li><span data-preserver-spaces=\"true\">Under Section 7(1), <\/span><span data-preserver-spaces=\"true\">customary rules and ceremonies must be followed<\/span><span data-preserver-spaces=\"true\"> for a Hindu marriage.\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Most Hindu groups practise Saptapadi, but not al<\/span><span data-preserver-spaces=\"true\">l.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Saptapad comprises the bride and groom walking seven steps before the sacred fire.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Section 7(2): If these rituals and ceremonies include Saptapadi, the marriage is complete and legally binding after the seventh stage.<\/span><\/li>\n<\/ul>\n<h3><strong>The Special Marriage Act (SMA) of 1954<\/strong><\/h3>\n<ul>\n<li><span data-preserver-spaces=\"true\">It allows legal marriage for Indians and Indian nationals abroad, regardless of religion or beliefs.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">When someone marries under this legislation, the SMA governs the marriage, not personal laws.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The recent Supreme Court ruling in Dolly Rani v Manish Kumar Chanchal that a Hindu marriage cannot be legitimate without a Saptapadi ceremony is misunderstood.
