Domestic <\/span><span data-preserver-spaces=\"true\">Violence<\/span><span data-preserver-spaces=\"true\"> happens on several pretexts <\/span><span data-preserver-spaces=\"true\">and<\/span><span data-preserver-spaces=\"true\"> it has a long-term impact on the lives of women. <\/span><span data-preserver-spaces=\"true\">It somehow integrated into society, and it became increasingly difficult to eradicate this problem. The Government of India saw this and swore to eliminate this problem to provide safety and security to the country&#8217;s women. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> is where the Protection of Women from Domestic Violence Act (PWDVA) came in.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The <\/span><span data-preserver-spaces=\"true\">Act<\/span> <span data-preserver-spaces=\"true\">was introduced<\/span><span data-preserver-spaces=\"true\"> to give voice to the victims who have suffered in silence due to societal stigma, lack of awareness, and absence of adequate safety systems. The <\/span><span data-preserver-spaces=\"true\">Act<\/span><span data-preserver-spaces=\"true\"> provides complete protection to women from different abuses like emotional, physical, mental, and even economic abuse. It gives women legal rights and remedies to fight against the wrongs <\/span><span data-preserver-spaces=\"true\">that <\/span><span data-preserver-spaces=\"true\">are<\/span><span data-preserver-spaces=\"true\"> done<\/span><span data-preserver-spaces=\"true\"> against them. It gives them the power to bring the wrongdoers to justice.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Therefore, <\/span><span data-preserver-spaces=\"true\">through this article, we explore the provisions of the <\/span><span data-preserver-spaces=\"true\">Act<\/span><span data-preserver-spaces=\"true\"> that empower women, the rights and remedies that are available, and the challenges faced in its implementation.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">Historical context\u00a0<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">The introduction of this <\/span><span data-preserver-spaces=\"true\">Act<\/span><span data-preserver-spaces=\"true\"> was <\/span><span data-preserver-spaces=\"true\">very<\/span><span data-preserver-spaces=\"true\"> crucial, as it aimed to protect the interests of women all over the country<\/span><span data-preserver-spaces=\"true\">. Earlier <\/span><span data-preserver-spaces=\"true\">to the introduction of the <\/span><span data-preserver-spaces=\"true\">Act<\/span><span data-preserver-spaces=\"true\">, the only option available to the users was <\/span><span data-preserver-spaces=\"true\">Section 498a of the Indian Penal Code [IPC], 1860.<\/span><span data-preserver-spaces=\"true\"> This provision criminalised cruelty by the husband and\/or his relatives, but it wasn&#8217;t comprehensive. The need was felt for more elaborate legislation that also covered <\/span><span data-preserver-spaces=\"true\">the aspect of<\/span><span data-preserver-spaces=\"true\"> victim relief.<\/span> <span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> is why PWDVA <\/span><span data-preserver-spaces=\"true\">was introduced<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">Key provisions\u00a0<\/span><\/strong><\/h2>\n<h3><strong><span data-preserver-spaces=\"true\">The PWDVA, enacted in the year 2006, has the following key provisions:<\/span><\/strong><\/h3>\n<ol>\n<li><strong>Definition of domestic violence<\/strong><span data-preserver-spaces=\"true\"><strong>:<\/strong> The <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> defined domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\"> in-depth, and due to this, acts like physical, emotional, sexual, verbal, and economic abuse <\/span><span data-preserver-spaces=\"true\">were included<\/span><span data-preserver-spaces=\"true\"> in the <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> of domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\">. The <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> applies to domestic relationships and includes husbands and in-laws as well.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Appointment of Protection Officers:<\/strong> The respective state governments are responsible for <\/span><span data-preserver-spaces=\"true\">the appointment of<\/span><span data-preserver-spaces=\"true\"> protection officers. The officers <\/span><span data-preserver-spaces=\"true\">are appointed<\/span><span data-preserver-spaces=\"true\"> in each district depending on the size and requirements of the area. In addition to this, these protection officers should be women only if p<\/span><span data-preserver-spaces=\"true\">ossible.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Counselling and Support:<\/strong> The <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> highlights the role of counselling as a support system for victims.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Incident Reports:<\/strong> The <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> has made <\/span><span data-preserver-spaces=\"true\">it compulsory to create<\/span><span data-preserver-spaces=\"true\"> a domestic incident report.<\/span> <span data-preserver-spaces=\"true\">This serves as important evidence <\/span><span data-preserver-spaces=\"true\">that has<\/span><span data-preserver-spaces=\"true\"> detailed documentation of <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\">. It<\/span><span data-preserver-spaces=\"true\"> ultimately helps in <\/span><span data-preserver-spaces=\"true\">the<\/span><span data-preserver-spaces=\"true\"> legal proceedings.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Shelter Homes:<\/strong> The victims <\/span><span data-preserver-spaces=\"true\">are provided<\/span><span data-preserver-spaces=\"true\"> with shelte<\/span><span data-preserver-spaces=\"true\">r homes. <\/span><span data-preserver-spaces=\"true\">In addition to the victims, if requested, the children are also accommodated here, <\/span><span data-preserver-spaces=\"true\">which gives a safe environment <\/span><span data-preserver-spaces=\"true\">to<\/span> <span data-preserver-spaces=\"true\">them<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<\/ol>\n<h2><strong><span data-preserver-spaces=\"true\">Rights and Remedies available\u00a0<\/span><\/strong><\/h2>\n<h3><strong><span data-preserver-spaces=\"true\">The aggrieved have the following rights and remedies:\u00a0<\/span><\/strong><\/h3>\n<ol>\n<li><span data-preserver-spaces=\"true\"><strong>Right to Reside:<\/strong> A woman has the <\/span><span data-preserver-spaces=\"true\">right to reside in a shared household <\/span><span data-preserver-spaces=\"true\">irrespective of<\/span><span data-preserver-spaces=\"true\"> the fact that<\/span><span data-preserver-spaces=\"true\"> whether she is the own<\/span><span data-preserver-spaces=\"true\">er or not.<\/span> <span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> ensures that no woman is forcibly removed from the house, <\/span><span data-preserver-spaces=\"true\">thereby<\/span><span data-preserver-spaces=\"true\"> threatening her sense of security.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Legal Recourse:<\/strong> A woman is now empowered to file a complaint against her husband or any <\/span><span data-preserver-spaces=\"true\">of his family members<\/span><span data-preserver-spaces=\"true\"> with appropriate authority. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> enables the woman to seek justice and ensure that she <\/span><span data-preserver-spaces=\"true\">is not subjected<\/span><span data-preserver-spaces=\"true\"> to exploitation or any other mis<\/span><span data-preserver-spaces=\"true\">treatment.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Safety from Abuse:<\/strong> As the <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> has recognised different forms of abuse, it also gives the woman safety from those abuses. It individually identifies and helps in addressing various forms of abuse by punishing the perpetrators.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Confidentiality:<\/strong> Any kinds of proceedings under this <\/span><span data-preserver-spaces=\"true\">Act<\/span><span data-preserver-spaces=\"true\"> are confidential. The identity of the victim is not to be disclosed under any circumstance.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Protection Orders:<\/strong> The <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> provides for protection orders that may be issued by a Magistrate if <\/span><span data-preserver-spaces=\"true\">he\/she is<\/span> <span data-preserver-spaces=\"true\">satisfied that domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\"> has taken place or is likely to take place.<\/span> <span data-preserver-spaces=\"true\">This will<\/span><span data-preserver-spaces=\"true\"> prevent the perpetrator <\/span><span data-preserver-spaces=\"true\">to come<\/span><span data-preserver-spaces=\"true\"> near the person and <\/span><span data-preserver-spaces=\"true\">commit<\/span><span data-preserver-spaces=\"true\"> any sort of crime. <\/span><span data-preserver-spaces=\"true\">This gives<\/span><span data-preserver-spaces=\"true\"> an immediate response to prevent any further unfortunate <\/span><span data-preserver-spaces=\"true\">incidents.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Residence Orders:<\/strong> The victims can obtain residence orders that allow them to stay at their shared household or any other place of their choice. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> ensures that the victims are not evicted forcefully by the accused or any of his family members.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Monetary Relief:<\/strong> Women can now claim monetary relief for any <\/span><span data-preserver-spaces=\"true\">sort of<\/span><span data-preserver-spaces=\"true\"> loss incurred during domestic<\/span> <span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\">. <\/span><span data-preserver-spaces=\"true\">This includes loss of earnings, medical expenses, and<\/span><span data-preserver-spaces=\"true\"> loss caused <\/span><span data-preserver-spaces=\"true\">due to<\/span> <span data-preserver-spaces=\"true\">destruction, damage, or removal of any property from the <\/span><span data-preserver-spaces=\"true\">control of the<\/span><span data-preserver-spaces=\"true\"> victim<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> Women are also entitled to <\/span><span data-preserver-spaces=\"true\">receive<\/span><span data-preserver-spaces=\"true\"> maintenance as per the Code of Criminal Procedure (CrPC).<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Custody Orders:<\/strong> If the Court is satisfied that the child will have an imminent threat living with the father, the mother can seek temporary custody to ensure the <\/span><span data-preserver-spaces=\"true\">well-being of the child<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Appeal:<\/strong> <\/span><span data-preserver-spaces=\"true\">In case the parties are not satisfied<\/span><span data-preserver-spaces=\"true\"> with the orders, they have the right to appeal to a higher court for further adjudication.<\/span><\/li>\n<\/ol>\n<h2><strong><span data-preserver-spaces=\"true\">Role of Protection Officers and Service Providers\u00a0<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">The protection officer is the person who has <\/span><span data-preserver-spaces=\"true\">been appointed<\/span><span data-preserver-spaces=\"true\"> to assist women in availing facilities and appropriate orders as per this <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\">. The officer can be a government servant or a social worker working in the field of women and child welfare. They have the authority to provide immediate assistance to victims who have faced domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\">. They also support victims by connecting them with legal aid services and other <\/span><span data-preserver-spaces=\"true\">kinds of<\/span><span data-preserver-spaces=\"true\"> needs during this trying time.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Service providers are usually <\/span><span data-preserver-spaces=\"true\">from<\/span><span data-preserver-spaces=\"true\"> NGOs and offer services like shelter, counselling, and medical assistance. They assist the victims in filing domestic incident reports and complaints with authorities to ensure that the case is legally recognised and <\/span><span data-preserver-spaces=\"true\">gets<\/span><span data-preserver-spaces=\"true\"> the appropriate action <\/span><span data-preserver-spaces=\"true\">by the authorities<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">Legal Procedures under the Act\u00a0<\/span><\/strong><\/h2>\n<h3><strong><span data-preserver-spaces=\"true\">The following steps may <\/span><span data-preserver-spaces=\"true\">be adopted<\/span><span data-preserver-spaces=\"true\"> by a woman who has suffered domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\">:\u00a0<\/span><\/strong><\/h3>\n<ol>\n<li><span data-preserver-spaces=\"true\"><strong>Filing of Complaint:<\/strong> The woman herself, the protection officer, or any other person who knows can proceed to apply. The application should be detailed, contain the specifics of the domestic violence incident, and provide the sought relief.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Domestic Incident Report (DIR):<\/strong> The report is created in a prescribed format <\/span><span data-preserver-spaces=\"true\">on the <\/span><span data-preserver-spaces=\"true\">receipt of<\/span><span data-preserver-spaces=\"true\"> a complaint of domestic <\/span><span data-preserver-spaces=\"true\">violence<\/span><span data-preserver-spaces=\"true\"> from an aggrieved person.<\/span> <span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> should be unbiased and <\/span><span data-preserver-spaces=\"true\">should have elaborate details of<\/span><span data-preserver-spaces=\"true\"> the incident.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Hearing Schedule:<\/strong> The magistrate <\/span><span data-preserver-spaces=\"true\">is required to<\/span><span data-preserver-spaces=\"true\"> complete the hearing within 60 days <\/span><span data-preserver-spaces=\"true\">from<\/span><span data-preserver-spaces=\"true\"> the first date <\/span><span data-preserver-spaces=\"true\">of the hearing<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Order:<\/strong> During the hearing, the magistrate can <\/span><span data-preserver-spaces=\"true\">give<\/span><span data-preserver-spaces=\"true\"> different orders <\/span><span data-preserver-spaces=\"true\">like<\/span><span data-preserver-spaces=\"true\"> protection orders, residence orders, custody orders, or monetary reliefs depending on the case at hand.<\/span><\/li>\n<\/ol>\n<h2><strong><span data-preserver-spaces=\"true\">Challenges and Limitations\u00a0<\/span><\/strong><\/h2>\n<h3><strong><span data-preserver-spaces=\"true\">Although the <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\"> is a significant step towards creating a safe society for women, however, several challenges affect the effectiveness of the <\/span><span data-preserver-spaces=\"true\">act<\/span><span data-preserver-spaces=\"true\">:<\/span><\/strong><\/h3>\n<ol>\n<li><span data-preserver-spaces=\"true\"><strong>Lack of Reporting:<\/strong> Often <\/span><span data-preserver-spaces=\"true\">due<\/span><span data-preserver-spaces=\"true\"> to societal stigma or family pressure, the victims hesitate to come forward and report the crimes that have happened against them.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Lack of Awareness:<\/strong> <\/span><span data-preserver-spaces=\"true\">There is a<\/span><span data-preserver-spaces=\"true\"> significant faction in our society <\/span><span data-preserver-spaces=\"true\">who are<\/span><span data-preserver-spaces=\"true\"> not aware of the rights that are available to assist them. This creates a situation of helplessness, as even though they <\/span><span data-preserver-spaces=\"true\">would<\/span><span data-preserver-spaces=\"true\"> want to take action, they <\/span><span data-preserver-spaces=\"true\">will<\/span><span data-preserver-spaces=\"true\"> not know where to proceed.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\"><strong>Economic dependency:<\/strong> In many cases, the victims are reliant on the perpetrators for <\/span><span data-preserver-spaces=\"true\">their<\/span><span data-preserver-spaces=\"true\"> survival, which creates a dilemma for them.
