Domestic <\/span>violence<\/span> has become a serious issue in Indian society.\u00a0 Women became subject to this torturous practice post-marriage due to dowry, drunken <\/span>violence<\/span>, and male dominance, among other reasons. Domestic <\/span>Violence<\/span> happens on several pretexts <\/span>and<\/span> it has a long-term impact on the lives of women. <\/span>It somehow integrated into society, and it became increasingly difficult to eradicate this problem. The Government of India saw this and swore to eliminate this problem to provide safety and security to the country’s women. <\/span>This<\/span> is where the Protection of Women from Domestic Violence Act (PWDVA) came in.<\/span><\/p>\n

The <\/span>Act<\/span> was introduced<\/span> to give voice to the victims who have suffered in silence due to societal stigma, lack of awareness, and absence of adequate safety systems. The <\/span>Act<\/span> provides complete protection to women from different abuses like emotional, physical, mental, and even economic abuse. It gives women legal rights and remedies to fight against the wrongs <\/span>that <\/span>are<\/span> done<\/span> against them. It gives them the power to bring the wrongdoers to justice.<\/span><\/p>\n

Therefore, <\/span>through this article, we explore the provisions of the <\/span>Act<\/span> that empower women, the rights and remedies that are available, and the challenges faced in its implementation.<\/span><\/p>\n

Historical context\u00a0<\/span><\/strong><\/h2>\n

The introduction of this <\/span>Act<\/span> was <\/span>very<\/span> crucial, as it aimed to protect the interests of women all over the country<\/span>. Earlier <\/span>to the introduction of the <\/span>Act<\/span>, the only option available to the users was <\/span>Section 498a of the Indian Penal Code [IPC], 1860.<\/span> This provision criminalised cruelty by the husband and\/or his relatives, but it wasn’t comprehensive. The need was felt for more elaborate legislation that also covered <\/span>the aspect of<\/span> victim relief.<\/span> This<\/span> is why PWDVA <\/span>was introduced<\/span>.<\/span><\/p>\n

Key provisions\u00a0<\/span><\/strong><\/h2>\n

The PWDVA, enacted in the year 2006, has the following key provisions:<\/span><\/strong><\/h3>\n

  1. Definition of domestic violence<\/strong>:<\/strong> The <\/span>act<\/span> defined domestic <\/span>violence<\/span> in-depth, and due to this, acts like physical, emotional, sexual, verbal, and economic abuse <\/span>were included<\/span> in the <\/span>act<\/span> of domestic <\/span>violence<\/span>. The <\/span>act<\/span> applies to domestic relationships and includes husbands and in-laws as well.<\/span><\/li>\n
  2. Appointment of Protection Officers:<\/strong> The respective state governments are responsible for <\/span>the appointment of<\/span> protection officers. The officers <\/span>are appointed<\/span> in each district depending on the size and requirements of the area. In addition to this, these protection officers should be women only if p<\/span>ossible.<\/span><\/li>\n
  3. Counselling and Support:<\/strong> The <\/span>act<\/span> highlights the role of counselling as a support system for victims.<\/span><\/li>\n
  4. Incident Reports:<\/strong> The <\/span>act<\/span> has made <\/span>it compulsory to create<\/span> a domestic incident report.<\/span> This serves as important evidence <\/span>that has<\/span> detailed documentation of <\/span>violence<\/span>. It<\/span> ultimately helps in <\/span>the<\/span> legal proceedings.<\/span><\/li>\n
  5. Shelter Homes:<\/strong> The victims <\/span>are provided<\/span> with shelte<\/span>r homes. <\/span>In addition to the victims, if requested, the children are also accommodated here, <\/span>which gives a safe environment <\/span>to<\/span> them<\/span>.<\/span><\/li>\n<\/ol>\n

    Rights and Remedies available\u00a0<\/span><\/strong><\/h2>\n

    The aggrieved have the following rights and remedies:\u00a0<\/span><\/strong><\/h3>\n
      \n
    1. Right to Reside:<\/strong> A woman has the <\/span>right to reside in a shared household <\/span>irrespective of<\/span> the fact that<\/span> whether she is the own<\/span>er or not.<\/span> This<\/span> ensures that no woman is forcibly removed from the house, <\/span>thereby<\/span> threatening her sense of security.<\/span><\/li>\n
    2. Legal Recourse:<\/strong> A woman is now empowered to file a complaint against her husband or any <\/span>of his family members<\/span> with appropriate authority. <\/span>This<\/span> enables the woman to seek justice and ensure that she <\/span>is not subjected<\/span> to exploitation or any other mis<\/span>treatment.<\/span><\/li>\n
    3. Safety from Abuse:<\/strong> As the <\/span>act<\/span> has recognised different forms of abuse, it also gives the woman safety from those abuses. It individually identifies and helps in addressing various forms of abuse by punishing the perpetrators.<\/span><\/li>\n
    4. Confidentiality:<\/strong> Any kinds of proceedings under this <\/span>Act<\/span> are confidential. The identity of the victim is not to be disclosed under any circumstance.<\/span><\/li>\n
    5. Protection Orders:<\/strong> The <\/span>act<\/span> provides for protection orders that may be issued by a Magistrate if <\/span>he\/she is<\/span> satisfied that domestic <\/span>violence<\/span> has taken place or is likely to take place.<\/span> This will<\/span> prevent the perpetrator <\/span>to come<\/span> near the person and <\/span>commit<\/span> any sort of crime. <\/span>This gives<\/span> an immediate response to prevent any further unfortunate <\/span>incidents.<\/span><\/li>\n
    6. Residence Orders:<\/strong> The victims can obtain residence orders that allow them to stay at their shared household or any other place of their choice. <\/span>This<\/span> ensures that the victims are not evicted forcefully by the accused or any of his family members.<\/span><\/li>\n
    7. Monetary Relief:<\/strong> Women can now claim monetary relief for any <\/span>sort of<\/span> loss incurred during domestic<\/span> violence<\/span>. <\/span>This includes loss of earnings, medical expenses, and<\/span> loss caused <\/span>due to<\/span> destruction, damage, or removal of any property from the <\/span>control of the<\/span> victim<\/span>.<\/span> Women are also entitled to <\/span>receive<\/span> maintenance as per the Code of Criminal Procedure (CrPC).<\/span><\/li>\n
    8. Custody Orders:<\/strong> If the Court is satisfied that the child will have an imminent threat living with the father, the mother can seek temporary custody to ensure the <\/span>well-being of the child<\/span>.<\/span><\/li>\n
    9. Appeal:<\/strong> <\/span>In case the parties are not satisfied<\/span> with the orders, they have the right to appeal to a higher court for further adjudication.<\/span><\/li>\n<\/ol>\n

      Role of Protection Officers and Service Providers\u00a0<\/span><\/strong><\/h2>\n

      The protection officer is the person who has <\/span>been appointed<\/span> to assist women in availing facilities and appropriate orders as per this <\/span>act<\/span>. The officer can be a government servant or a social worker working in the field of women and child welfare. They have the authority to provide immediate assistance to victims who have faced domestic <\/span>violence<\/span>. They also support victims by connecting them with legal aid services and other <\/span>kinds of<\/span> needs during this trying time.<\/span><\/p>\n

      Service providers are usually <\/span>from<\/span> NGOs and offer services like shelter, counselling, and medical assistance. They assist the victims in filing domestic incident reports and complaints with authorities to ensure that the case is legally recognised and <\/span>gets<\/span> the appropriate action <\/span>by the authorities<\/span>.<\/span><\/p>\n

      Legal Procedures under the Act\u00a0<\/span><\/strong><\/h2>\n

      The following steps may <\/span>be adopted<\/span> by a woman who has suffered domestic <\/span>violence<\/span>:\u00a0<\/span><\/strong><\/h3>\n
        \n
      1. Filing of Complaint:<\/strong> The woman herself, the protection officer, or any other person who knows can proceed to apply. The application should be detailed, contain the specifics of the domestic violence incident, and provide the sought relief.<\/span><\/li>\n
      2. Domestic Incident Report (DIR):<\/strong> The report is created in a prescribed format <\/span>on the <\/span>receipt of<\/span> a complaint of domestic <\/span>violence<\/span> from an aggrieved person.<\/span> This<\/span> should be unbiased and <\/span>should have elaborate details of<\/span> the incident.<\/span><\/li>\n
      3. Hearing Schedule:<\/strong> The magistrate <\/span>is required to<\/span> complete the hearing within 60 days <\/span>from<\/span> the first date <\/span>of the hearing<\/span>.<\/span><\/li>\n
      4. Order:<\/strong> During the hearing, the magistrate can <\/span>give<\/span> different orders <\/span>like<\/span> protection orders, residence orders, custody orders, or monetary reliefs depending on the case at hand.<\/span><\/li>\n<\/ol>\n

        Challenges and Limitations\u00a0<\/span><\/strong><\/h2>\n

        Although the <\/span>act<\/span> is a significant step towards creating a safe society for women, however, several challenges affect the effectiveness of the <\/span>act<\/span>:<\/span><\/strong><\/h3>\n

        1. Lack of Reporting:<\/strong> Often <\/span>due<\/span> to societal stigma or family pressure, the victims hesitate to come forward and report the crimes that have happened against them.<\/span><\/li>\n
        2. Lack of Awareness:<\/strong> <\/span>There is a<\/span> significant faction in our society <\/span>who are<\/span> not aware of the rights that are available to assist them. This creates a situation of helplessness, as even though they <\/span>would<\/span> want to take action, they <\/span>will<\/span> not know where to proceed.<\/span><\/li>\n
        3. Economic dependency:<\/strong> In many cases, the victims are reliant on the perpetrators for <\/span>their<\/span> survival, which creates a dilemma for them. In these cases, they often do not raise their voices and stay victims <\/span>throughout their lives<\/span>.\u00a0<\/span><\/li>\n<\/ol>\n
