{"id":159908,"date":"2025-03-24T13:45:14","date_gmt":"2025-03-24T08:15:14","guid":{"rendered":"https:\/\/www.mapsofindia.com\/my-india\/?p=159908"},"modified":"2025-03-22T16:32:47","modified_gmt":"2025-03-22T11:02:47","slug":"what-is-the-immigration-and-foreigners-bill-2025","status":"publish","type":"post","link":"https:\/\/www.mapsofindia.com\/my-india\/government\/what-is-the-immigration-and-foreigners-bill-2025","title":{"rendered":"What Is The Immigration And Foreigners&#8217; Bill, 2025?"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">To fortify India&#8217;s borders and simplify the Immigration and Foreigners laws, the Union government presented the Immigration and Foreigners Bill, 2025 last week in the Lok Sabha. <\/span><span data-preserver-spaces=\"true\">The Passport (Entry into India) Act of 1920, the Registration of Foreigners Act of 1939, and the Foreigners Act of 1936 are three pre-independence laws which are replaced and repealed by the Immigration (Carriers\u2019 Liability) Act of 2000. While introducing the bill, Minister of State (MoS) Home Affairs Nityanand Rai said, \u201cWe are not bringing this law to stop anyone from coming to India\u201d.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Statement of Objects and Reasons submitted alongside the Bill mentions that the Acts \u201care not only of the pre-Constitution period, but <\/span><span data-preserver-spaces=\"true\">also, <\/span><span data-preserver-spaces=\"true\">they<\/span><span data-preserver-spaces=\"true\"> were brought<\/span><span data-preserver-spaces=\"true\"> into extraordinary times of first and second world wars\u201d.\u00a0 It also highlights the requirement for comprehensive law and <\/span><span data-preserver-spaces=\"true\">the existence of<\/span><span data-preserver-spaces=\"true\"> overlapping rules.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The new bill would give the central government the authority to regulate foreigners. It also mandates that passports or other travel papers <\/span><span data-preserver-spaces=\"true\">be obtained<\/span><span data-preserver-spaces=\"true\"> by anybody <\/span><span data-preserver-spaces=\"true\">who is<\/span><span data-preserver-spaces=\"true\"> entering or departing India<\/span><span data-preserver-spaces=\"true\">. According to the Immigration and Foreigners Bill, 2025&#8217;s Statement of Objects and Reasons, the proposed law addresses several immigration-related issues, including the duties of immigration agents, the need for passports and visas, and other things<\/span><span data-preserver-spaces=\"true\">. <\/span><span data-preserver-spaces=\"true\">The measure would outline issues about foreigners and their registration<\/span><span data-preserver-spaces=\"true\">, as well as<\/span><span data-preserver-spaces=\"true\"> the role that hospitals, colleges, and other medical facilities play in admitting foreign people.<\/span><\/p>\n<h2><strong><span data-preserver-spaces=\"true\">Key Aspects of the Bill\u00a0<\/span><\/strong><\/h2>\n<p><span data-preserver-spaces=\"true\">The Bill suggests building a Bureau of Immigration, led by a commissioner and backed by several immigration agent<\/span><span data-preserver-spaces=\"true\">s.\u00a0 According to the duties outlined by the Center, the Bureau shall operate under the administration of the central government and be in charge of managing the admission and departure of foreign nationals.\u00a0 Section 7 of the Bill provides the Center Board authority to regulate foreign national travel and activities within India.\u00a0 Among these are as fol<\/span><span data-preserver-spaces=\"true\">lows:<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Foreign<\/span><span data-preserver-spaces=\"true\"> citizens would have to register <\/span><span data-preserver-spaces=\"true\">when they arrive<\/span><span data-preserver-spaces=\"true\"> in India <\/span><span data-preserver-spaces=\"true\">under the new bill<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">\u00a0 Other rules consist of:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Mobility restrictions inside India, including the prohibition of entering protected and restricted places without prior authorisation.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Restricting identity changes and name ch<\/span><span data-preserver-spaces=\"true\">anges.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Nursing homes, hospitals, and educational institutions will have <\/span><span data-preserver-spaces=\"true\">to report the presence of foreign nationals to immigration<\/span><span data-preserver-spaces=\"true\"> officials.<\/span><\/li>\n<\/ul>\n<h2><strong><span data-preserver-spaces=\"true\">Punishments under Immigration and Foreigners Bill, 2025<\/span><\/strong><\/h2>\n<ul>\n<li><span data-preserver-spaces=\"true\">Foreigners who enter India without proper documentation risk a punishment of up to \u20b95 lakh and five years in<\/span><span data-preserver-spaces=\"true\"> jail.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">A minimum sentence of two years in prison, with the possibility of a seven-year sentence, and a fine of \u20b91 lakh to \u20b910 lakh might be imposed for using fake travel papers. Hospitals and educational institutions <\/span><span data-preserver-spaces=\"true\">are required to<\/span><span data-preserver-spaces=\"true\"> provide authorised registration officials with information on international patients and pupils.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Foreigners who outstay on their visa or violate the rules may <\/span><span data-preserver-spaces=\"true\">be jailed<\/span><span data-preserver-spaces=\"true\"> for up to three years, fined up to \u20b93 lakh or both. <\/span><span data-preserver-spaces=\"true\">If transport companies (ships, <\/span><span data-preserver-spaces=\"true\">airplanes<\/span><span data-preserver-spaces=\"true\">, are caught transporting foreigners without proper documentation, they may be penalised up to \u20b95 <\/span><span data-preserver-spaces=\"true\">lakh<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> The transport vehicle may be seized or put behind bars if the fine <\/span><span data-preserver-spaces=\"true\">is not paid<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">The Bill gives the central government the power to control or limit foreigners\u2019 ability to enter, leave, and travel.\u00a0 Foreigners may be asked to pay for their departure, register using biometrics, or stay away from particular locations.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Airlines, shipping firms, and other transportation providers are subject to a great deal of accountability under the measure.\u00a0 Important clauses consist of: Carriers that carry foreign nationals without proper documentation risk a fine of up to \u20b95 lakh.
